Prohibited and Restricted Items

An item or service cannot be listed, purchased, or sold through PeppermintProfile when the transaction would violate applicable federal, state, or local law.

Sellers are responsible for ensuring that an item is legal in the seller’s location, the buyer’s location, and every jurisdiction involved in shipping or delivery.

The following are prohibited:

• Illegal goods or services
• Stolen property
• Counterfeit, fake, or unauthorized replica goods
• Products that infringe copyrights, trademarks, patents, or other intellectual-property rights
• Items intended to facilitate illegal activity or conceal its detection

The following cannot be sold directly through the Marketplace:

• Illegal drugs and controlled substances
• Cannabis and cannabis-derived intoxicating products
• Prescription medicine
• Drug-production materials or products marketed primarily for illegal drug use
• Regulated medical products that PeppermintProfile cannot lawfully process

Alcohol, tobacco, nicotine products, vaping products, and vaping liquids cannot be sold directly through PeppermintProfile at launch.

The following are prohibited from direct Marketplace sale:

• Firearms
• Legally regulated firearm frames and receivers
• Ammunition
• Components intended to manufacture ammunition, including primers and propellant
• Explosives and explosive devices
• Military ordnance

Disguised weapons, illegally modified weapons, and items prohibited by applicable law are not allowed.

An accessory is prohibited if the specific component is legally regulated, intended to create a prohibited weapon, or illegal in a location involved in the transaction.

The following are prohibited:

• Unsafe, contaminated, adulterated, or recalled products
• Products containing illegal or undisclosed ingredients
• False or misleading medical claims
• Products advertised as preventing, treating, or curing a disease without lawful authorization
• Expired products when selling them would be unsafe or illegal

Used, opened, tester, decanted, repackaged, contaminated, counterfeit, recalled, or illegally labeled cosmetics are prohibited.

Products recalled by a manufacturer or government safety agency cannot be sold.

Items officially identified as unsafe, illegally manufactured, or dangerous under normal use are prohibited.

Materials are prohibited when they are illegal to possess or ship, or when they present an unreasonable risk of poisoning, fire, explosion, corrosion, infection, or radiation. Examples include industrial poisons, explosives and fireworks, fuel, highly concentrated acids, radioactive material, infectious specimens, and leaking or damaged hazardous products.

The following are prohibited:

• Stolen credentials or account access
• Passwords, authentication codes, or compromised accounts
• Stolen or unlawfully shared personal information
• Forged identification or official documents
• Malware, ransomware, spyware, or computer viruses
• Devices or software marketed for unauthorized access, tracking, interception, or surveillance

Pornography and sexually explicit content or imagery remain prohibited everywhere on PeppermintProfile.

Material involving minors, sexual exploitation, nonconsensual conduct, or illegal obscene content is strictly prohibited.

Used, opened, tester, or otherwise previously used adult products are prohibited.

The following are prohibited:

• Human organs, tissue, cells, blood, and bodily fluids
• Human remains or body parts, except lawful educational or historical items specifically approved by PeppermintProfile
• Items contaminated with bodily material
• Used intimate products sold for sexual or fetish purposes

Live animals cannot be sold directly through the Marketplace.

Products made from endangered, threatened, trafficked, or legally protected species are prohibited.

The following are prohibited from direct sale or offer through the Marketplace:

• Lottery tickets
• Unlicensed raffles
• Gambling services
• Wagers
• Chance-based purchases
• Listings that conceal what the buyer will receive

Ordinary promotional giveaways are not currently allowed as Marketplace products and may be considered later only under a separate, expressly authorized program.

The following cannot be sold directly through the Marketplace at launch:

• Securities, investment contracts, and insurance products
• Cryptocurrency or currency-exchange services
• Gift cards, prepaid cards, and stored-value accounts
• Loans or credit products
• Accounts containing funds or transferable balances

At launch, digital goods, downloads, subscriptions, activation keys, in-game goods or accounts, shared or stolen accounts, pirated media or software, and other electronically fulfilled products cannot be sold directly through the Marketplace.

Products containing malicious code or designed to enable unauthorized access remain prohibited.

A seller may not advertise a product they have no reasonable ability or intention to provide.

Products and listings that promote, fund, celebrate, or recruit for hatred, terrorism, criminal violence, or unlawful organizations are prohibited.

Lawfully operating pharmacies, dispensaries, and related businesses may maintain informational profiles and advertise their lawful services. Transactions must occur through their own legally compliant systems.

Lawfully operating breweries, wineries, liquor stores, cigar shops, vape shops, and similar businesses may maintain informational profiles and advertise their lawful operations.

Licensed firearm businesses may maintain informational profiles and direct visitors to their own legally compliant sales and transfer processes.

PeppermintProfile does not automatically prohibit an item merely because it may be considered a weapon or self-defense product.

Knives, darts, airsoft products, BB products, pepper spray, lawful stun devices, and similar products may be listed only when they are legal in every jurisdiction involved in the transaction and can be shipped legally.

Sellers are responsible for age restrictions, shipping restrictions, required warnings, and destination exclusions.

Hazardous products may be listed only when the item is lawful, the shipping carrier accepts it, and every packaging, labeling, and transportation requirement can be followed. Explosives remain prohibited regardless.

Ordinary retail items—such as perfume, aerosol products, paint, cleaning supplies, lithium-battery devices, and pool chemicals—are not automatically banned. They may be listed only when the product is lawful and the seller follows the carrier’s required quantity limits, packaging, labeling, and shipping method. If a carrier will not legally accept the item, it cannot be sold for shipment through PeppermintProfile.

When a dedicated age-gated category is available, new, lawful adult and sexual-wellness products may be sold only within that category, and only viewers who are 18 or older may access it.

Listings in that category must use non-explicit presentation. Accounts identified as belonging to anyone under 18 cannot access the category.

Lawful breeders, shelters, rescues, farms, and animal-related businesses may maintain informational profiles, subject to animal-welfare rules.

Lawful taxidermy and ordinary animal products may be sold only when the seller can establish that the item is legal.

Coins, collectible currency, precious metals, gemstones, and jewelry may be sold only by a verified business approved by PeppermintProfile.

Verification may consider identity, legal business existence, established operating history, an existing company presence or website, legitimacy, and the business’s ability to support authenticity and provenance. Casual or unverified sellers may not list items in these categories.

A lawful business may advertise digital services or products through an informational business profile, but checkout and delivery must occur through its own system.

Historical, journalistic, artistic, or educational materials may be considered in context, provided they do not promote or glorify prohibited conduct.

Ordinary unregulated accessories may be sold when legal, including:

• Cases and storage products
• Cleaning supplies
• Scopes and optics
• Hearing and eye protection
• Holsters and lawful protective equipment

Lawful food, homemade food, dietary supplements, vitamins, and similar products may be sold when they are safely made, properly packaged, accurately labeled, and legal to ship.

Lawful cosmetics, including products made by small and home-based businesses, may be sold when they are safely produced and properly labeled.

Cosmetics and personal-care products must be new, unused, unexpired, and factory-sealed when the manufacturer originally sells them sealed.

Legitimate security, privacy, recovery, and anti-malware products remain allowed.

Ordinary used clothing is not prohibited merely because it has been worn.

PeppermintProfile will not automatically prohibit print-on-demand, custom-made products, production partners, or lawful dropshipping.

The seller must have a legitimate fulfillment arrangement, disclose material delivery information, and remain responsible for the product, shipping, customer service, returns, and accuracy of the listing.
